| 1 | AMENDMENT TO SENATE BILL 2031

| 2 | AMENDMENT NO. ______. Amend Senate Bill 2031, AS AMENDED, | ||||||
| 3 | by replacing everything after the enacting clause with the | ||||||
| 4 | following:
| ||||||
| 5 | "Section 5. The Illinois Public Aid Code is amended by | ||||||
| 6 | changing Section 11-4.1 as follows: | ||||||
| 7 | (305 ILCS 5/11-4.1) | ||||||
| 8 | Sec. 11-4.1. Medical providers assisting with applications | ||||||
| 9 | for medical assistance. A provider enrolled to provide medical | ||||||
| 10 | assistance services may, upon the request of an applicant | ||||||
| 11 | individual, accompany, represent, and assist the applicant | ||||||
| 12 | individual in applying for medical assistance under Article V | ||||||
| 13 | of this Code, including the pursuit of any appeals related to | ||||||
| 14 | the application, on behalf of the applicant during the | ||||||
| 15 | applicant's life and after the applicant's death. If an | ||||||
| 16 | applicant individual is unable to request such assistance due | ||||||
| |||||||
| |||||||
| 1 | to incapacity or mental incompetence and has no other | ||||||
| 2 | representative willing or able to assist in the application | ||||||
| 3 | process, a facility licensed under the Nursing Home Care Act, | ||||||
| 4 | the ID/DD Community Care Act, or the MC/DD Act or certified | ||||||
| 5 | under this Code is authorized to assist the applicant | ||||||
| 6 | individual in applying for long-term care services, including | ||||||
| 7 | the pursuit of any appeals related to the application, on | ||||||
| 8 | behalf of the applicant during the applicant's life and after | ||||||
| 9 | the applicant's death. Subject to the provisions of the Free | ||||||
| 10 | Healthcare Benefits Application Assistance Act, nothing in | ||||||
| 11 | this Section shall be construed as prohibiting any individual | ||||||
| 12 | or entity from assisting another individual in applying for | ||||||
| 13 | medical assistance under Article V of this Code.
