AMENDMENT TO SENATE BILL 1773




2    AMENDMENT NO. ______. Amend Senate Bill 1773 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Illinois Public Aid Code is amended  by 
5changing Section 11-4.1 as follows:
 
6    (305 ILCS 5/11-4.1)
7    Sec. 11-4.1. Medical providers assisting with applications 
8for medical assistance. A provider enrolled to provide medical 
9assistance services may, upon the request of an individual, 
10accompany, represent, and assist the individual in applying for 
11medical assistance under Article V of this Code. If an 
12individual is unable to request such assistance due to 
13incapacity or mental incompetence and has no other 
14representative willing or able to assist in the application 
15process,  a facility licensed under the Nursing Home Care Act, 
16the ID/DD Community Care Act, or the MC/DD Act or certified

1under this Code is authorized to assist the individual in 
2applying  for long-term care services.  The provider shall use 
3the Department's Approved Representative Consent Form (IL 
4444-2998) and the Appeal Request Form (IL 444-0103) or any 
5successor form promulgated by the Department, which shall 
6survive the individual's death, for authorization. Subject to 
7the provisions of   the Free Healthcare Benefits Application 
8Assistance Act, nothing in this Section shall be construed as 
9prohibiting any individual or entity from assisting another 
10individual in applying for medical assistance under Article V 
11of this Code.

13    Section 99. Effective date. This Act takes effect upon 
14becoming law.".
