| 2 |  |     Be it enacted by the People of the State of Illinois,  | 
| 3 |  | represented in the General Assembly: 
 | 
| 4 |  | Article 5. Department of Natural Resources.
 | 
| 5 |  |     Section 5-5. The Director of the Department of Natural  | 
| 6 |  | Resources, on behalf of the State of Illinois, is authorized to  | 
| 7 |  | execute and deliver to the Fox Waterway Agency, a  | 
| 8 |  | special-purpose unit of local government organized and  | 
| 9 |  | existing under the laws of this State, for and in consideration  | 
| 10 |  | of $1 paid to the Department, a quit claim deed to the  | 
| 11 |  | following described real property:

| 14 |  | the National Historic Preservation Act of 1966, as amended, and  | 
| 15 |  | the regulations promulgated under that Act (36 CFR Part 800.4). | 
| 16 |  |     2. No construction, alteration, or disturbance of the  | 
| 17 |  | ground surface or structure older than 50 years shall be  | 
| 18 |  | undertaken or permitted to be undertaken on the aforesaid  | 
| 19 |  | property without the express prior written permission of the  | 
| 20 |  | Illinois Department of Natural Resources, Comprehensive  | 
| 21 |  | Environmental Review Program who may require archaeological or  | 
| 22 |  | environmental surveys and/or site or structure mitigation  | 
| 23 |  | prior to any undertaking. | 
| 24 |  |     3. The Illinois Department of Natural Resources shall be  | 
| 25 |  | permitted at all reasonable times to inspect the aforesaid  | 
| 26 |  | property in order to ascertain if the above conditions are  |

| 6 |  | violation or to require the restoration or mitigation of  | 
| 7 |  | natural resources or archaeological sites or structures  | 
| 8 |  | disturbed by construction, alteration, or disturbance of the  | 
| 9 |  | ground surface or structure older than 50 years. | 
| 10 |  |     5. The Grantee agrees that the Illinois Department of  | 
| 11 |  | Natural Resources may, at its sole discretion and without prior  | 
| 12 |  | notice to the Grantee, convey and assign all or part of its  | 
| 13 |  | rights and responsibilities contained herein to a third party.  | 
| 14 |  | Written notice will be sent to the Grantee, to the attention of  | 
| 15 |  | its Executive Director, within thirty (30) days of any such  | 
| 16 |  | transfer. | 
| 17 |  |     6. This covenant is binding on the Grantee, its successors  | 
| 18 |  | and assignees in perpetuity.  Restrictions, stipulations, and  | 
| 19 |  | covenants contained herein shall be inserted by the Grantee  | 
| 20 |  | verbatim or by express reference in any deed or other legal  | 
| 21 |  | instrument by which it divests itself of either the fee simple  | 
| 22 |  | title or any other lesser estate in the property. | 
| 23 |  |     7. The failure of the Illinois Department of Natural  |
