| 7 | | retain, whether paid or on a volunteer basis, any individual in |
| 8 | | a position with duties involving direct care of clients, |
| 9 | | patients, or residents who has a finding by the Department of |
| 10 | | Human Services of physical or sexual abuse, financial |
| 11 | | exploitation, or egregious neglect of an individual denoted on |
| 12 | | the Health Care Worker Registry."; and

| 13 | | by replacing line 21 on page 62 through line 4 of page 63 with |
| 14 | | the "employee has abused or neglected a resident or |
| 15 | | misappropriated property of a resident, then the Department |
| 16 | | shall notify the employee or individual of this finding by |
| 17 | | certified mail sent to the address contained in the Health Care |
| 18 | | Worker Registry. The notice shall give the employee or |
| 19 | | individual an opportunity to contest the finding in a hearing |
| 20 | | before the Department or to submit a written response to the |
| 21 | | findings in lieu of requesting a hearing. As used in this |
| 22 | | subsection, "abuse" and "neglect" shall have the meanings |
| 23 | | provided in the Nursing Home Care Act, except that the term |

| 1 | | "resident" as used in those definitions shall have the meaning |
| 2 | | provided in this Act. As used in this subsection, |
| 3 | | "misappropriate property of a resident" shall have the meaning |
| 4 | | provided to "misappropriation of a resident's property" in the |
| 5 | | Nursing Home Care Act, except that the term "resident" as used |
| 6 | | in that definition shall have the meaning provided in this |
| 7 | | Act."; and

|
| 10 | | on page 67, line 6, by replacing "(d)" with "(c)"; and
