SYNOPSIS AS INTRODUCED:

405 ILCS 5/3-802

from Ch. 91 1/2, par. 3-802

Amends the Mental Health and Developmental Disabilities Code. Provides that when requested, a jury trial must be commenced within 15 days of the request unless a subsequent continuance is requested by the respondent. Provides that in counties of less than 500,000 inhabitants, a jury trial must be commenced within 30 days of the request unless a subsequent continuance is requested by the respondent.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Mental Health and Developmental Disabilities Code is amended by changing Section 3-802 as follows:

Sec. 3-802. The respondent is entitled to a jury on the question of whether he or she is subject to involuntary admission on an inpatient or outpatient basis. When requested, a jury trial must be commenced within 15 days of the request unless a subsequent continuance is requested by the respondent. However, in counties of less than 500,000 inhabitants, a jury trial must be commenced within 30 days of the request unless a subsequent continuance is requested by the respondent. The jury shall consist of 6 persons to be chosen in the same manner as are jurors in other civil proceedings. A respondent is not entitled to a jury on the question of whether psychotropic medication or electroconvulsive therapy may be administered under Section 2-107.1.
