AMENDMENT TO SENATE BILL 58




2    AMENDMENT NO. ______. Amend Senate Bill 58 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 5. The Police and Community Relations Improvement  
5Act is amended  by adding Section 1-25 as follows:
 
6    (50 ILCS 727/1-25 new)
7    Sec. 1-25. Drug and alcohol testing.
8    (a)  As used in this Section, "officer-involved shooting" 
9means any instance when a law enforcement officer discharges 
10his or her firearm, causing injury or death to a person or 
11persons,  during the performance of his or her official duties 
12or in the line of duty. 
13    (b)  Each law enforcement agency shall adopt a written 
14policy regarding drug and alcohol testing following an 
15officer-involved shooting.  The written policy adopted by the 
16law enforcement agency must include the following

1requirements:
2        (1) each law enforcement officer who is involved in an 
3    officer-involved shooting must submit to drug and alcohol 
4    testing; and
5        (2)  the drug and alcohol testing must be completed as 
6    soon as practicable after the officer-involved shooting 
7    but no later than the end of the involved officer's shift 
8    or tour of duty. 
 
 
9    Section 99. Effective date. This Act takes effect upon 
10becoming law.".
