AMENDMENT TO HOUSE BILL 4792 




2    AMENDMENT NO. ______. Amend House Bill 4792 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Property Tax Code is amended  by changing 
5Sections 11-155,  11-160, and  11-165 as follows:
 



6    (35 ILCS 200/11-155)



7    Sec. 11-155. Certification and assessment authority. For 
8tax purposes, a
qualifying water treatment facility shall be 
9certified as such by providing to the Department proof of a 
10valid facility number issued by the Illinois Environmental 
11Protection Agency the Director
of Natural Resources and shall 
12be assessed by the Department
of Revenue.

15    Sec. 11-160. Effective date of certificates Approval

1procedure. Application for approval as a qualifying
water 
2treatment facility shall be filed with the Department of 
3Natural
Resources in the manner and form prescribed by the 
4Director of National
Resources.  The application shall contain 
5appropriate and available descriptive
information concerning 
6anything claimed to be entitled to tax treatment as
defined in 
7this Division 4.  If it is found that the facility meets the

8definition, the Director of Natural Resources, or his or her

9duly authorized designee, shall enter a finding and issue a 
10certificate that
requires tax treatment as a qualifying water 
11treatment facility.  The effective
date of a certificate shall 
12be on January 1 preceding the date of certification
or 
13preceding the date construction or installation of the facility 
14commences,
whichever is later.

17    Sec. 11-165. Judicial review; qualifying water treatment 
18facilities. Any
applicant or holder aggrieved by the issuance, 
19refusal to issue, denial,
revocation, modification, or 
20restriction of a qualifying water treatment
facility 
21certificate may appeal the finding and order of the Department 
22of
Revenue Natural Resources under the Administrative Review 
23Law.
