| 1 | AN ACT concerning local government.
| |||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||||
| 3 | represented in the General Assembly:

| 4 | Section 5. The Township Code is amended by changing | |||||||||||||||||||||||
| 5 | Sections 50-5 and 50-10 and by adding Section 75-50 as follows:
| |||||||||||||||||||||||
| 6 | (60 ILCS 1/50-5)
| |||||||||||||||||||||||
| 7 | Sec. 50-5. Time of election and terms outside Cook County.
| |||||||||||||||||||||||
| 8 | (a) Except as provided for Cook County in Sections Section | |||||||||||||||||||||||
| 9 | 50-10 and 75-50, and subject to the
requirements of the general | |||||||||||||||||||||||
| 10 | election law and the referendum provisions in
Sections 50-25 | |||||||||||||||||||||||
| 11 | and 50-30, at the time of the regular township election | |||||||||||||||||||||||
| 12 | provided
in the general election law, there shall be elected | |||||||||||||||||||||||
| 13 | one township collector.
The collector shall hold his office for | |||||||||||||||||||||||
| 14 | a term of 4 years and until a successor
is elected and | |||||||||||||||||||||||
| 15 | qualified.

| 16 | (b) At the time of the regular township election provided | |||||||||||||||||||||||
| 17 | in the general
election law, there shall be elected a township | |||||||||||||||||||||||
| 18 | supervisor. The supervisor
shall be ex-officio supervisor of | |||||||||||||||||||||||
| 19 | general assistance. The supervisor shall hold
office for a term | |||||||||||||||||||||||
| 20 | of 4 years and until a successor is elected and qualified.

| 21 | (c) At the time of the regular township election provided | |||||||||||||||||||||||
| 22 | in the general
election law, there shall be elected one | |||||||||||||||||||||||
| 23 | township clerk. The clerk shall hold
office for a term of 4 | |||||||||||||||||||||||
| |||||||
| |||||||
| 1 | years and until a successor is elected and qualified.
| ||||||
| 2 | (d) At the time of the regular township election provided | ||||||
| 3 | in the general
election law, there shall be elected by ballot | ||||||
| 4 | one township or multi-township
assessor, as the case may be, in | ||||||
| 5 | the manner provided in the general election
law. The assessor | ||||||
| 6 | shall hold office for a term of 4 years and until a successor
| ||||||
| 7 | is elected and qualified.

| 10 | Sec. 50-10. Time of election and terms in Cook County.
| ||||||
| 11 | (a) Except as provided for in Section 75-50, township | ||||||
| 12 | Township supervisors, township clerks, and township collectors | ||||||
| 13 | shall be
elected in their respective townships in Cook County | ||||||
| 14 | at the time of the regular
township election provided in the | ||||||
| 15 | general election law. They shall hold their
offices for 4 years | ||||||
| 16 | and until their successors are elected and qualified.
| ||||||
| 17 | (b) Those townships in Cook County lying outside the | ||||||
| 18 | corporate limits of the
City of Chicago, the boundaries of | ||||||
| 19 | which are co-extensive with the corporate
limits of a city, | ||||||
| 20 | village, or incorporated town, shall elect a township
assessor | ||||||
| 21 | at the time of the regular township election provided in the | ||||||
| 22 | general
election law. Those township assessors shall hold their | ||||||
| 23 | offices for 4 years
and until their successors are elected and | ||||||
| 24 | qualified.

| 1 | (60 ILCS 1/75-50 new) | ||||||
| 2 | Sec. 75-50. Appointment of township clerk. | ||||||
| 3 | (a) If the township board determines that the township | ||||||
| 4 | clerk has not fulfilled the duties of the office of the | ||||||
| 5 | township clerk, the township board may, by resolution, provide | ||||||
| 6 | that the office of the township clerk shall no longer be an | ||||||
| 7 | elected position, but shall be appointed by the township board. | ||||||
| 8 | After adoption of a resolution to appoint the township clerk, | ||||||
| 9 | the elected township clerk's term ends on the appointment of a | ||||||
| 10 | new township clerk or at the end of the elected township | ||||||
| 11 | clerk's term, whichever is earlier. | ||||||
| 12 | (b) After a resolution has been adopted under subsection | ||||||
| 13 | (a), voters may initiate a petition for referendum, signed by | ||||||
| 14 | at least 10% of the total number of voters voting at the last | ||||||
| 15 | general election at which the last township clerk was elected, | ||||||
| 16 | to elect the township clerk and file the petition with the | ||||||
| 17 | county clerk not less than 78 days before a regular election. | ||||||
| 18 | The county clerk shall certify for submission the proposition | ||||||
| 19 | of electing the township clerk in accordance with the general | ||||||
| 20 | election law. The proposition shall be in substantially the | ||||||
| 21 | following form: | ||||||
| 22 | Shall the township clerk be elected for the (name of | ||||||
| 23 | township)? | ||||||
| 24 | The votes shall be recorded as "Yes" or "No". If a majority | ||||||
| 25 | of the voters voting on the proposition in the township vote in | ||||||
| |||||||
| |||||||
| 1 | favor of it, then the township clerk shall be elected in the | ||||||
| 2 | township at the next regular election for township offices. The | ||||||
| 3 | appointed township clerk's term shall end when a successor is | ||||||
| 4 | elected and qualified.
