Amends the Criminal Code of 2012. Creates the offense of kindling a fire on a public way. Provides that a person commits the offense when he or she knowingly lights, kindles, or burns a fire on the surface of a road, street, or other public way. Provides exemptions. Provides that a violation is a petty offense for which a fine not exceeding $1,000 may be imposed.

| 1 | | AN ACT concerning criminal law.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Criminal Code of 2012 is amended by adding |
| 5 | | Section 26-8 as follows: |
| 6 | | (720 ILCS 5/26-8 new) |
| 7 | | Sec. 26-8. Kindling a fire on a public way. |
| 8 | | (a) A person commits kindling a fire on a public way when |
| 9 | | he or she knowingly lights, kindles, or burns a fire on the |
| 10 | | surface of a road, street, or other public way. |
| 11 | | (b) This Section does not apply to: |
| 12 | | (1) persons engaged in construction work in a |
| 13 | | construction or maintenance speed zone as defined in |
| 14 | | Section 11-605.1 of the Illinois Vehicle Code; |
| 15 | | (2) the use of a flare by emergency personnel; or |
| 16 | | (3) the use of a flare to signal approaching traffic of |
| 17 | | an emergency or disabled vehicle. |
| 18 | | (c) Sentence. Kindling a fire on a public way is a petty |
| 19 | | offense for which a fine not exceeding $1,000 may be imposed.
