AMENDMENT TO HOUSE BILL 3449

AMENDMENT NO. ______. Amend House Bill 3449 on page 1, line 12, by replacing "location" with "the precise location"; and

on page 2, by inserting immediately below line 22 the following:

"(c) A private entity need not obtain a person's affirmative express consent after the person's initial consent as described in subsection (a) has been obtained unless the terms previously agreed to under items (1), (2), and (3) of subsection (a) are materially changed."; and

on page 2, line 23, by changing "(c)" to "(d)"; and

on page 2, by replacing line 25 with the following:

"Section 15. Violation. A violation of this Act constitutes a violation of the Consumer Fraud and Deceptive Business Practices Act. Only a State's Attorney or the Attorney General may enforce a violation of this Act as an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act."; and

on page 3, by deleting lines 1 through 18; and

on page 3, line 19, by changing "25" to "20"; and

on page 4, line 1, by changing "30" to "25"; and

on page 4, by replacing lines 7 and 8 with the following: "1999 and the rules promulgated thereunder; (iii) Internet, wireless, or telecommunications service providers; (iv) cable or video service providers under Article XXI of the Public Utilities Act; or (v) a person licensed as a private detective pursuant to the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004."; and

on page 5, by deleting lines 16 and 17.
