1    AN ACT concerning education.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  



 
 
4    Section 5. The State Finance Act is amended  by changing 
5Section 5.652 and by adding Section 5.878 as follows:
 


6    (30 ILCS 105/5.652)


7    Sec. 5.652. The ICCB Research and Technology Instructional 
8Development and Enhancement Applications Revolving  Fund.

11    Sec. 5.878. The BHE Data and Research Cost Recovery Fund.
 
12    Section 7. The Board of Higher Education Act is amended by 
13adding Section 9.36 as follows:
 
14    (110 ILCS 205/9.36 new)
15    Sec. 9.36. Processing fee.
16    (a)   The Board may collect a fee to cover the cost of 
17processing and handling individual student-level data requests 
18pursuant to an approved data sharing agreement. The fee shall 
19not be assessed on any entities that are complying with State 
20or federal-mandated reporting. The fee shall be set by the

1Board by rule. Money from the fee shall be deposited into the 
2BHE Data and Research Cost Recovery Fund.
3    (b)   The BHE Data and Research Cost Recovery Fund is created 
4as a special fund in the State treasury. The Board shall 
5deposit into the Fund moneys received from processing requests 
6for individual student-level data.  All moneys in the Fund shall 
7be used by the Board, subject to appropriation, for costs 
8associated with maintaining and updating the individual 
9student-level data systems.
 
10    Section 10. The Public Community College Act is amended  by 
11changing Section 2-16.09 and  by adding Section 2-11.2 as 
12follows:
 
13    (110 ILCS 805/2-11.2 new)
14    Sec. 2-11.2. Processing fee. The State Board may collect a 
15fee to cover the cost of processing and handling individual 
16student-level data requests pursuant to an approved data 
17sharing agreement. The fee shall not be assessed on any 
18entities that are complying with State or federal-mandated 
19reporting. The fee shall be set by the Board by rule. Money 
20from the fee shall be deposited into the ICCB Research and 
21Technology Fund.

23    Sec. 2-16.09. ICCB Research and Technology Instructional

1Development and Enhancement Applications Revolving Fund. The 
2ICCB Research and Technology Instructional Development and 
3Enhancement Applications Revolving Fund is created as a special 
4fund in the State treasury. The State Board shall deposit  into 
5the Fund moneys received by the State Board from the sale of 
6instructional technology developed by the State Board and all 
7moneys received from processing requests for individual 
8student-level data. All moneys in the Fund shall be used by the 
9State Board, subject to appropriation by the General Assembly, 
10for costs associated with maintaining and updating that 
11instructional technology and individual student-level data 
12systems.

14    Section 99. Effective date. This Act takes effect July 1, 
152017.
