| 1 | | AN ACT concerning regulation.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Fire Protection District Act is amended by |
| 5 | | adding Section 3.3 as follows:
|
| 6 | | (70 ILCS 705/3.3 new) |
| 7 | | Sec. 3.3. Annexation of covered areas. A fire protection |
| 8 | | district may annex into its jurisdiction property for which the |
| 9 | | district is providing coverage under Section 10.2 of the |
| 10 | | Emergency Telephone System Act by adoption of an ordinance |
| 11 | | annexing the property. In addition to the required public |
| 12 | | notifications prior to an ordinance adoption, the fire |
| 13 | | protection district shall give notice by U.S. certified mail at |
| 14 | | least 20 days prior to the hearing to the property owner or |
| 15 | | owners of the time and place of the hearing and a copy of the |
| 16 | | proposed ordinance. At the hearing, all persons having an |
| 17 | | interest in the matter shall have an opportunity to be heard. |
| 18 | | Following adoption of the annexation ordinance, a certified |
| 19 | | copy of the annexation ordinance shall be transmitted by the |
| 20 | | secretary of the district to each of the following: the county |
| 21 | | clerk of the county in which the property is located; the |
| 22 | | Office of the State Fire Marshal; and the owner or owners of |
| 23 | | the property or properties annexed by the ordinance. On the |
