AMENDMENT TO HOUSE BILL 2734 




2    AMENDMENT NO. ______. Amend House Bill 2734 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Personnel Record Review Act is amended  by 
5changing Section 8 as follows:
 



6    (820 ILCS 40/8)  (from Ch. 48, par. 2008)



7    Sec. 8. 
An employer shall review a personnel record before 
8releasing
information to a third party and, except when the 
9release is ordered to
a party in a legal action or arbitration,  
10delete disciplinary reports,
letters of reprimand, or other 
11records of disciplinary action which are
more than 4 years old.

12    An employer that is a law enforcement agency, as defined in 
13Section 107-4 of the Code of Criminal Procedure of 1963, shall 
14keep disciplinary reports, letters of reprimand, and other 
15records of disciplinary action relating to employees who are 
16peace officers, as defined in Section 107-4 of the Code of
