| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Radon Resistant Construction Act is amended |
| 5 | | by changing Section 15 as follows:
|
| 6 | | (420 ILCS 52/15)

| 7 | | Sec. 15. Definitions. As used in this Act, unless the |
| 8 | | context requires otherwise: |
| 9 | | "Active mitigation system", also known as "active soil |
| 10 | | depressurization" or "ASD", means a family of radon mitigation |
| 11 | | systems involving mechanically driven soil depressurization, |
| 12 | | including sub-slab depressurization (SSD), drain tile |
| 13 | | depressurization (DTD), block wall depressurization (BWD), and |
| 14 | | sub-membrane depressurization (SMD). |
| 15 | | "Agency" means the Illinois Emergency Management Agency.

| 16 | | "New residential construction" means any original |

| 1 | | construction of a single-family home or a dwelling containing 2 |
| 2 | | or fewer apartments, condominiums, or town houses.
|
| 3 | | "Passive new construction pipe" means a pipe installed in |
| 4 | | new construction that relies solely on the convective flow of |
| 5 | | air upward for soil gas depressurization and may consist of |
| 6 | | multiple pipes routed through conditioned space from below the |
| 7 | | foundation to above the roof.
|
| 8 | | "Radon" means a gaseous radioactive decay product of |
| 9 | | uranium or thorium.
|
| 10 | | "Radon contractor" means a person licensed in accordance |
| 11 | | with the Radon Industry Licensing Act to perform radon or radon |
| 12 | | progeny mitigation or to perform measurements of radon or radon |
| 13 | | progeny in an indoor atmosphere.
|
| 14 | | "Radon resistant construction" means the installation of |
| 15 | | passive new construction pipe during new residential |
| 16 | | construction.
|
| 17 | | "Residential building code" means an ordinance, |
| 18 | | resolution, or law that establishes standards applicable to new |
| 19 | | residential construction.
|
| 20 | | "Residential building contractor" means any individual, |
| 21 | | corporation, or partnership that constructs new residential |
| 22 | | construction.
|
| 23 | | "Task Force on Radon-Resistant Building Codes" means the |
| 24 | | Task Force on Radon-Resistant Building Codes as authorized by |
| 25 | | the Radon Industry Licensing Act.
