AN ACT concerning transportation. | ||||
Be it enacted by the People of the State of Illinois, | ||||
represented in the General Assembly: | ||||
Section 5. The Illinois Vehicle Code is amended by | ||||
changing Sections 1-118.1, 2-106, 3-307, 3-701, 3-804, | ||||
7-603.5, and 7-605 and by adding Section 2-123.5 as follows: | ||||
(625 ILCS 5/1-118.1) | ||||
Sec. 1-118.1. Expanded-use antique vehicle. | ||||
A motor vehicle that is more than 25 years of age or a bona | ||||
fide replica thereof and which is registered and driven on the | ||||
highways in accordance with Section 3-804.01. "Expanded-use | ||||
antique vehicle" does not include a commercial vehicle, as | ||||
defined under Section 1-111.8, or a farm truck, as defined | ||||
under Section 3-815. | ||||

Sec. 2-106. Secretary of State to prescribe forms. | ||||
The Secretary of State shall prescribe or provide suitable | ||||
forms of applications, certificates of title, registration | ||||
cards, driver's licenses and such other forms requisite or | ||||
deemed necessary to carry out the provisions of this Act and | ||||
any other laws pertaining to vehicles the enforcement and | ||||
administration of which are vested in the Secretary of State. | ||
Any entity or vendor providing services to or on behalf of the | ||
Secretary of State may also prescribe or provide suitable | ||
forms under this Section to the extent authorized by the | ||
Secretary of State and upon approval of the Secretary of | ||
State. | ||

Sec. 2-123.5. Confidentiality of highly restricted | ||
personal information contained in vehicle title and | ||
registration records. | ||
(a) An individual's photograph or image, signature, social | ||
security number, personal email address, and medical or | ||
disability information as may be submitted to the Secretary of | ||
State for purposes of a vehicle title and registration | ||
application shall be confidential and shall not be disclosed, | ||
except as provided under this Section. | ||
(b) Except for medical or disability information and | ||
social security numbers, any information deemed confidential | ||
under subsection (a) may be disclosed to the following | ||
persons: | ||
(1) the individual to whom the application and | ||
personal information pertains, upon written request of | ||
that person; | ||
(2) officers and employees of the Secretary of State | ||
who have a need to have access to such personal | ||
information for purposes related to vehicle title and | ||
registration administration as authorized under this Code; | ||
(3) law enforcement officials for a civil or criminal | ||
law enforcement investigation, except as restricted by | ||
Section 6-110.3, Section 3.5 of the Uniform Interstate | ||
Depositions and Discovery Act, or the Lawful Health Care | ||
Activity Act; and | ||
(4) a person requesting disclosure of such information | ||
pursuant to a court order directing the Secretary of State | ||
to release the requested confidential information. | ||
(c) Medical or disability information deemed confidential | ||
under this Section may be disclosed as provided under | ||
subsection (j) of Section 2-123. | ||
(d) Social security numbers or any associated information | ||
obtained from the Social Security Administration deemed | ||
confidential under this Section may be disclosed as provided | ||
under subsection (h) of Section 2-123. | ||

Sec. 3-307. Short term permit. The Secretary of State | ||
shall issue at no charge a short term permit to a licensed | ||
rebuilder for (i) any vehicle for which an application for a | ||
certificate of title for a rebuilt vehicle will be submitted | ||
or (ii) any vehicle which is or may have been salvaged has been | ||
made under this Article and which must be driven on the roads | ||
and highways of this State to a place of inspection. | ||

Sec. 3-701. Operation of vehicles without evidence of | ||
registration - Operation under mileage plates when odometer | ||
broken or disconnected. | ||
(a) No person shall operate, nor shall an owner knowingly | ||
permit to be operated, except as provided in subsection (b) of | ||
this Section, a vehicle upon any highway unless there shall be | ||
attached thereto and displayed thereon when and as required by | ||
law, proper evidence of registration in Illinois, as follows: | ||
(1) A vehicle required to be registered in Illinois. A | ||
current and valid Illinois registration sticker or | ||
stickers and plate or plates or digital registration | ||
sticker or stickers and digital plate or plates, or an | ||
Illinois temporary registration permit, or a drive-away or | ||
in-transit permit, issued therefor by the Secretary of | ||
State. | ||
(2) A vehicle eligible for Reciprocity. A current and | ||
valid reciprocal foreign registration plate or digital | ||
registration plate or plates properly issued to such | ||
vehicle or a temporary registration issued therefor, by | ||
the reciprocal State, and, in addition, when required by | ||
the Secretary, a current and valid Illinois Reciprocity | ||
Permit or Prorate Decal issued therefor by the Secretary | ||
of State; or except as otherwise expressly provided for in | ||
this Chapter. | ||
(3) A vehicle commuting for repairs in Illinois. A | ||
dealer plate issued by a foreign state shall exempt a | ||
vehicle from the requirements of this Section if the | ||
vehicle is being operated for the purpose of transport to | ||
a repair facility in Illinois to have repairs performed on | ||
the vehicle displaying foreign dealer plates. The driver | ||
of the motor vehicle bearing dealer plates shall provide a | ||
work order or contract with the repair facility to a law | ||
enforcement officer upon request. | ||
(b) A person may operate or permit operation of a vehicle | ||
upon any highway a vehicle that has been properly registered | ||
but does not display a current and valid Illinois registration | ||
sticker or digital registration sticker if he or she has | ||
proof, in the form of a printed receipt from the Secretary, | ||
that he or she registered the vehicle before the previous | ||
registration's expiration but has not received a new | ||
registration sticker or digital registration sticker from the | ||
Secretary. This printed proof of registration is valid for 30 | ||
days from the expiration of the previous registration | ||
sticker's or digital registration sticker's date or 30 days | ||
from the purchase date of the new registration sticker or | ||
digital registration sticker, whichever occurs later. | ||
(c) No person shall operate, nor shall any owner knowingly | ||
permit to be operated, any vehicle of the second division for | ||
which the owner has made an election to pay the mileage tax in | ||
lieu of the annual flat weight tax, at any time when the | ||
odometer of such vehicle is broken or disconnected, or is | ||
inoperable or not operating. | ||

Sec. 3-804. Antique vehicles. | ||
(a) The owner of an antique vehicle may register such | ||
vehicle for a fee not to exceed $6 per registration year $13 | ||
for a 2-year antique plate. The application for registration | ||
must be accompanied by an affirmation of the owner that such | ||
vehicle will be driven on the highway only for the purpose of | ||
going to and returning from an antique auto show or an | ||
exhibition, or for servicing or demonstration and also | ||
affirming that the mechanical condition, physical condition, | ||
brakes, lights, glass, and appearance of such vehicle is the | ||
same or as safe as originally equipped. The Secretary may, in | ||
his discretion, prescribe that antique vehicle plates be | ||
issued for a definite or an indefinite term, such term to | ||
correspond to the term of registration plates issued | ||
generally, as provided in Section 3-414.1. In no event may the | ||
registration fee for antique vehicles exceed $6 per | ||
registration year. Any person requesting antique plates under | ||
this Section may also apply to have vanity or personalized | ||
plates as provided under Section 3-405.1. | ||
(b) Any person who is the registered owner of an antique | ||
vehicle may display a historical Illinois-issued license plate | ||
that represents the model year of the vehicle, furnished by | ||
such person, in lieu of the current and valid Illinois antique | ||
vehicle plates issued thereto, provided that valid and current | ||
Illinois antique vehicle plates and registration card issued | ||
to such antique vehicle are simultaneously carried within such | ||
vehicle and are available for inspection. | ||

Sec. 7-603.5. Electronic verification of a liability | ||
insurance policy. | ||
(a) The Secretary may implement a program of electronic | ||
motor vehicle liability insurance policy verification for | ||
motor vehicles subject to Section 7-601 of this Code for the | ||
purpose of verifying whether or not the motor vehicle is | ||
insured. The development and implementation of the program | ||
shall be consistent with the standards and procedures of a | ||
nationwide organization whose primary membership consists of | ||
individual insurance companies and insurance trade | ||
associations. The program shall include, but is not limited | ||
to: | ||
(1) a requirement that an insurance company authorized | ||
to sell motor vehicle liability insurance in this State | ||
shall make available, in a format designated by the | ||
Secretary that is consistent with a nationwide | ||
organization whose primary membership consists of | ||
individual insurance companies and insurance trade | ||
organizations, to the Secretary for each motor vehicle | ||
liability insurance policy issued by the company the | ||
following information: | ||
(A) the name of the policy holder; | ||
(B) the make, model, year, and vehicle | ||
identification number of the covered motor vehicle; | ||
(C) the policy number; | ||
(D) the policy effective date; | ||
(E) the insurance company's National Association | ||
of Insurance Commissioner's number; and | ||
(F) any other information the Secretary deems | ||
necessary to match an eligible vehicle with an | ||
insurance policy; | ||
(2) a method for searching motor vehicle liability | ||
insurance policies issued and in effect in this State by | ||
using the information under paragraph (1) of this | ||
subsection (a); | ||
(3) a requirement that at least twice per calendar | ||
year, the Secretary shall verify the existence of a | ||
liability insurance policy for every registered motor | ||
vehicle subject to Section 7-601 of this Code; and if the | ||
Secretary is unable to verify the existence of a liability | ||
insurance policy, the Secretary shall, by U.S. mail or | ||
electronic mail, send the vehicle owner a written notice | ||
allowing the vehicle owner 30 calendar days to provide | ||
proof of insurance on the date of attempted verification, | ||
or to provide proof that the vehicle is no longer | ||
operable; | ||
(4) a requirement that a vehicle owner who does not | ||
provide proof of insurance or proof of an inoperable | ||
vehicle within the 30 calendar days specified under | ||
paragraph (3) of this subsection (a) shall be in violation | ||
of Section 7-601 of this Code and the Secretary shall | ||
suspend the vehicle's registration upon expiration of that | ||
30 calendar days and the owner shall pay any applicable | ||
reinstatement fees and shall provide proof of insurance | ||
before the Secretary may reinstate the vehicle's | ||
registration under Section 7-606 of this Code; | ||
(5) a requirement that if a vehicle owner provides | ||
proof of insurance on the date of the attempted | ||
verification under paragraph (3) of this subsection (1), | ||
the Secretary may verify the vehicle owner's response by | ||
furnishing necessary information to the insurance company. | ||
Within 7 calendar days of receiving the information, the | ||
insurance company shall confirm and notify the Secretary | ||
the dates of the motor vehicle's insurance coverage. If | ||
the insurance company does not confirm coverage for the | ||
date of attempted verification, the Secretary shall | ||
suspend the vehicle's registration and the owner of the | ||
vehicle shall pay any applicable reinstatement fees and | ||
shall provide proof of insurance before the Secretary may | ||
reinstate the vehicle's registration under Section 7-606 | ||
of this Code; | ||
(6) a requirement that the Secretary may consult with | ||
members of the insurance industry during the | ||
implementation of the program, including, but not limited | ||
to, during the drafting process for adopting any rules | ||
that may be necessary to implement or manage an electronic | ||
motor vehicle liability insurance policy verification | ||
program; | ||
(7) a requirement that commercial lines of automobile | ||
insurance are excluded from the program, but may | ||
voluntarily report insurance coverage to the State. | ||
(b) In addition to the semi-annual verification of | ||
liability insurance under subsection (a) of this Section, the | ||
Secretary may select monthly verification for a motor vehicle | ||
owned or registered by a person: | ||
(1) whose motor vehicle registration during the | ||
preceding 4 years has been suspended under Section 7-606 | ||
or 7-607 of this Code; | ||
(2) who, during the preceding 4 years, has been | ||
convicted of violating Section 3-707, 3-708, or 3-710 of | ||
this Code while operating a vehicle owned by another | ||
person; | ||
(3) whose driving privileges have been suspended | ||
during the preceding 4 years; | ||
(4) who, during the preceding 4 years, acquired | ||
ownership of a motor vehicle while the registration of the | ||
vehicle under the previous owner was suspended under | ||
Section 7-606 or 7-607 of this Code; or | ||
(5) who, during the preceding 4 years, has received a | ||
disposition of court supervision under subsection (c) of | ||
Section 5-6-1 of the Unified Code of Corrections for a | ||
violation of Section 3-707, 3-708, or 3-710 of this Code. | ||
(c) Nothing in this Section provides the Secretary with | ||
regulatory authority over insurance companies. | ||
(d) The Secretary may contract with a private contractor | ||
to carry out the Secretary's duties under this Section. | ||
(e) Any information collected, stored, maintained, or | ||
referred to under this Section shall be used solely for the | ||
purpose of verifying whether a registered motor vehicle meets | ||
the requirements of Section 7-601 of this Code and shall be | ||
exempt from a records request or from inspection and copying | ||
under the Freedom of Information Act. A request for release of | ||
verification of liability insurance policy information from | ||
the Secretary shall require a court order, subpoena, or the | ||
motor vehicle owner's approval. | ||
(f) An insurer identified by an electronic motor vehicle | ||
liability insurance policy program as insuring less than 1,000 | ||
vehicles per year shall be exempt from the reporting | ||
requirements under subsection (a) of this Section. | ||
(g) The Secretary may adopt any rules necessary to | ||
implement this Section. | ||

Sec. 7-605. Uninsured motor vehicles - notice. If the | ||
Secretary determines that an owner has registered or | ||
maintained the registration of a motor vehicle without a | ||
liability insurance policy in accordance with Section 7-601 of | ||
this Code, the Secretary shall notify the owner that such | ||
owner's vehicle registration shall be suspended 30 45 days | ||
after the date of the mailing of the notice unless the owner | ||
within 30 days furnishes proof of insurance in effect on the | ||
verification date, as prescribed by the Secretary, or provides | ||
an exemption from the mandatory insurance requirements as | ||
specified under subsection (b) of Section 7-601. | ||
Notwithstanding any provision of law to the contrary, the | ||
giving of notice by mail under this Section or Section 7-603.5 | ||
shall be deemed complete upon the deposit of that notice in the | ||
mail and the 30-day notice period shall begin upon deposit. | ||

Section 99. Effective date. This Act takes effect upon | ||
