AMENDMENT TO SENATE BILL 1327

AMENDMENT NO. ______. Amend Senate Bill 1327 by replacing everything after the enacting clause with the following:

"Section 5. The Illinois Insurance Code is amended by adding Section 370c.5 as follows:

(215 ILCS 5/370c.5 new)

Sec. 370c.5. Parity in benefits under disability income insurance. On and after January 1, 2028, every insurer that amends, delivers, issues, or renews a group or individual policy or certificate of disability income insurance in this State shall ensure that:

(1) the benefits for disability resulting from mental, emotional, nervous, or substance use disorders or conditions are no more restrictive than the benefits resulting from all other medical conditions covered by the policy or certificate, and there are no separate requirements applicable only with respect to benefits for disability resulting from mental, emotional, nervous, or substance use disorders or conditions; and

(2) the limitations on the duration of benefit payments or other coverage limitations applicable to disability resulting from mental, emotional, nervous, or substance use disorders or conditions are no more restrictive than the benefits available for disability resulting from other physical conditions covered by the policy, and there are no separate payment limitations that may be applied specifically with respect to disability resulting from mental, emotional, nervous, or substance use disorders or conditions.

Section 99. Effective date. This Act takes effect January 1, 2028.".
