| 1 | AN ACT concerning education. | ||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | ||||||||||||||||||||||||
| 3 | represented in the General Assembly: | ||||||||||||||||||||||||
| 4 | Section 5. The School Code is amended by adding Section | ||||||||||||||||||||||||
| 5 | 14-8.02j as follows: | ||||||||||||||||||||||||
| 6 | (105 ILCS 5/14-8.02j new) | ||||||||||||||||||||||||
| 7 | Sec. 14-8.02j. Timelines for creating disability | ||||||||||||||||||||||||
| 8 | accommodations under Section 504 of the federal Rehabilitation | ||||||||||||||||||||||||
| 9 | Act of 1973. | ||||||||||||||||||||||||
| 10 | (a) For purposes of this Section: | ||||||||||||||||||||||||
| 11 | "Health care provider" means a physician licensed to | ||||||||||||||||||||||||
| 12 | practice medicine in all of its branches, a licensed physician | ||||||||||||||||||||||||
| 13 | assistant, or a licensed advanced practice registered nurse. | ||||||||||||||||||||||||
| 14 | Individualized health care plan means a document used to guide | ||||||||||||||||||||||||
| 15 | a student's health care in the school setting. | ||||||||||||||||||||||||
| 16 | (b) Within 14 school days after receiving a written | ||||||||||||||||||||||||
| 17 | request for a federal Section 504 plan from a child's parent or | ||||||||||||||||||||||||
| 18 | guardian, a school district shall determine whether the | ||||||||||||||||||||||||
| 19 | clinical information provided by the parent or guardian is | ||||||||||||||||||||||||
| 20 | sufficient to support the need for a Section 504 plan, whether | ||||||||||||||||||||||||
| 21 | further evaluation is warranted to make that determination, or | ||||||||||||||||||||||||
| 22 | whether there is no basis for an evaluation or plan based on | ||||||||||||||||||||||||
| 23 | available information. If the district decides not to confer | ||||||||||||||||||||||||

| 1 | eligibility based on existing information or to conduct an | ||||||
| 2 | evaluation, the district shall provide written notice to the | ||||||
| 3 | parent or guardian explaining the rationale for the decision. | ||||||
| 4 | If the district agrees to an evaluation, a meeting with the | ||||||
| 5 | parent or guardian shall be held no later than 14 school days | ||||||
| 6 | after receiving the written request. The district shall | ||||||
| 7 | convene a team composed of the parent or guardian and | ||||||
| 8 | individuals having the knowledge and skills necessary to | ||||||
| 9 | administer and interpret evaluation data. The team shall | ||||||
| 10 | identify the assessments necessary to complete the evaluation. | ||||||
| 11 | The composition of the team may vary depending upon the nature | ||||||
| 12 | of the child's symptoms and other relevant factors. The | ||||||
| 13 | district shall ensure that the notification of the team's | ||||||
| 14 | conclusions is transmitted to the parent or guardian within | ||||||
| 15 | the 14-school-day timeline applicable under this subsection | ||||||
| 16 | (b) along with the district's request for the parent's or | ||||||
| 17 | guardian's consent to conduct the needed assessments. | ||||||
| 18 | (c) For a student with documentation from a licensed | ||||||
| 19 | health care provider indicating the need for an individualized | ||||||
| 20 | health care plan to address a likely medical threat to the | ||||||
| 21 | student's health or safety, the school's Section 504 plan team | ||||||
| 22 | shall meet with the parent or guardian to consider creation of | ||||||
| 23 | an interim Section 504 plan consistent with the health care | ||||||
| 24 | provider's recommendations within 5 school days after receipt | ||||||
| 25 | of the documentation. If the Section 504 plan team agrees with | ||||||
| 26 | the health care provider's recommendation, implementation of | ||||||

| 1 | the requisite accommodations shall commence no later than 5 | ||||||
| 2 | school days after the planning meeting. | ||||||
| 3 | (d) Nothing in this Section supersedes the requirements | ||||||
| 4 | included in Section 22-30 of this Code, the Care of Students | ||||||
| 5 | with Diabetes Act, or the Seizure Smart School Act. | ||||||
| 6 | Section 99. Effective date. This Act takes effect upon | ||||||
| 7 | becoming law. | ||||||
