| 1 | AN ACT concerning public aid. | |||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||||
| 4 | Section 5. The Illinois Public Aid Code is amended by | |||||||||||||||||||||
| 5 | adding Sections 5-18.6 and 5-18.7 as follows: | |||||||||||||||||||||
| 6 | (305 ILCS 5/5-18.6 new) | |||||||||||||||||||||
| 7 | Sec. 5-18.6. Doula policies; hospitals and birthing | |||||||||||||||||||||
| 8 | centers. | |||||||||||||||||||||
| 9 | (a) Each hospital and birthing center shall adopt and | |||||||||||||||||||||
| 10 | maintain written policies and procedures authorizing a patient | |||||||||||||||||||||
| 11 | enrolled in the medical assistance program to select an | |||||||||||||||||||||
| 12 | Illinois Medicaid certified and enrolled doula of the | |||||||||||||||||||||
| 13 | patient's choice to accompany the patient within the | |||||||||||||||||||||
| 14 | facility's premises for the purposes of providing support | |||||||||||||||||||||
| 15 | before, during, and after labor and childbirth, and during the | |||||||||||||||||||||
| 16 | patient's entire postpartum stay. | |||||||||||||||||||||
| 17 | (1) The doula shall be considered part of the | |||||||||||||||||||||
| 18 | patient's care team and essential to patient care. | |||||||||||||||||||||
| 19 | (2) The doula shall not be counted as a support person | |||||||||||||||||||||
| 20 | or against the guest quota before, during, or after | |||||||||||||||||||||
| 21 | childbirth. | |||||||||||||||||||||
| 22 | (b) Each hospital and birthing center shall provide a | |||||||||||||||||||||
| 23 | written copy of the policies and procedures adopted in | |||||||||||||||||||||
| |||||||
| |||||||
| 1 | accordance with subsection (a) to: | ||||||
| 2 | (1) each health care provider providing maternity | ||||||
| 3 | services at the facility; | ||||||
| 4 | (2) each patient receiving maternity services at the | ||||||
| 5 | facility; and | ||||||
| 6 | (3) any other person, at the request of the patient. | ||||||
| 7 | (c) Each hospital and birthing center shall post a summary | ||||||
| 8 | of the facility's policies and procedures adopted in | ||||||
| 9 | accordance with subsection (a) on the facility's website. | ||||||
| 10 | (d) Each hospital and birthing center shall designate a | ||||||
| 11 | staff member to serve as a liaison between the facility and | ||||||
| 12 | Illinois Medicaid enrolled doulas and doula organizations in | ||||||
| 13 | order to provide and communicate information concerning the | ||||||
| 14 | facility's policies and procedures adopted in accordance with | ||||||
| 15 | subsection (a). | ||||||
| 16 | (e) At the request of the hospital or birthing facility, | ||||||
| 17 | Illinois Medicaid enrolled doulas must provide written | ||||||
| 18 | acknowledgment of Illinois Medicaid doula certification and | ||||||
| 19 | enrollment in the medical assistance program. | ||||||

| 21 | Sec. 5-18.7. Standing recommendations. The Department of | ||||||
| 22 | Healthcare and Family Services and the Department of Public | ||||||
| 23 | Health may establish standing recommendations to meet Centers | ||||||
| 24 | for Medicare and Medicaid Services requirements and ensure | ||||||
| 25 | access to preventive services, including Medicaid-covered | ||||||
| |||||||
| |||||||
| 1 | maternal and reproductive health supports and services, such | ||||||
| 2 | as, but not limited to, doulas, lactation consultants, home | ||||||
| 3 | visitors, community health workers, and 1115 Waiver services. | ||||||
| 4 | No employee of the Department of Healthcare and Family | ||||||
| 5 | Services or the Department of Public Health issuing a standing | ||||||
| 6 | recommendation in accordance with this Section shall, as a | ||||||
| 7 | result of the employee's acts or omissions in issuing the | ||||||
| 8 | standing recommendation, be subject to (i) any disciplinary or | ||||||
| 9 | other adverse action under the Medical Practice Act of 1987, | ||||||
| 10 | (ii) any civil liability, or (iii) any criminal liability. | ||||||
