| 1 | AN ACT concerning public aid. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 1. This Act may be referred to as the Strengthen | |||||||||||||||||||
| 5 | Linkage to Follow-Up Care after a Behavioral Health Crisis | |||||||||||||||||||
| 6 | Act. | |||||||||||||||||||
| 7 | Section 5. The Illinois Public Aid Code is amended by | |||||||||||||||||||
| 8 | adding Section 5-37.5 as follows: | |||||||||||||||||||
| 9 | (305 ILCS 5/5-37.5 new) | |||||||||||||||||||
| 10 | Sec. 5-37.5. Strengthen linkage to follow-up care after a | |||||||||||||||||||
| 11 | behavioral health crisis. | |||||||||||||||||||
| 12 | (a) Purpose. The purpose of this Section is to strengthen | |||||||||||||||||||
| 13 | access to immediate follow-up treatment after a child or adult | |||||||||||||||||||
| 14 | experiences a mental health or substance use crisis and | |||||||||||||||||||
| 15 | eliminate administrative barriers that impede timely linkage | |||||||||||||||||||
| 16 | to care. | |||||||||||||||||||
| 17 | (b) Bridging treatment lags between crisis services and | |||||||||||||||||||
| 18 | follow-up mental health services. For purposes of timely | |||||||||||||||||||
| 19 | linking an individual to follow-up mental health care | |||||||||||||||||||
| 20 | immediately after a behavioral health crisis, when mobile | |||||||||||||||||||
| 21 | crisis response services, as defined in 89 Ill. Adm. Code | |||||||||||||||||||
| 22 | 140.453(d)(3), are provided to someone in a behavioral health | |||||||||||||||||||
| |||||||
| |||||||
| 1 | crisis, the Department-approved Illinois Medicaid-Crisis | ||||||
| 2 | Assessment Tool shall enable delivery of the services listed | ||||||
| 3 | below when delivered by the same provider, for up to 30 days | ||||||
| 4 | without beginning, performing, or completing an integrated | ||||||
| 5 | assessment and treatment plan: | ||||||
| 6 | (1) Community support services, as defined in 89 Ill. | ||||||
| 7 | Adm. Code 140.453(d)(2)(A). | ||||||
| 8 | (2) Medication administration, as defined in 89 Ill. | ||||||
| 9 | Adm. Code 140.453(d)(2)(C). | ||||||
| 10 | (3) Medication monitoring, as defined in 89 Ill. Adm. | ||||||
| 11 | Code 140.453(d)(2)(D). | ||||||
| 12 | (4) Medication training, as defined in 89 Ill. Adm. | ||||||
| 13 | Code 140.453(d)(2)(E). | ||||||
| 14 | (5) Targeted case management services, as defined in | ||||||
| 15 | 89 Ill. Adm. Code 140.453(e). | ||||||
| 16 | The services listed in paragraphs (1) through (5) shall be | ||||||
| 17 | billed separate from mobile crisis response services. | ||||||
| 18 | (c) For purposes of this Section, no more stringent | ||||||
| 19 | requirements for the Illinois Medicaid-Crisis Assessment Tool | ||||||
| 20 | shall be imposed by the Department than those requirements | ||||||
| 21 | that exist on the effective date of this amendatory Act of the | ||||||
| 22 | 104th General Assembly, as long as the services provided in | ||||||
| 23 | accordance with this Section are delivered under the | ||||||
| 24 | supervision of a licensed practitioner of the healing arts. | ||||||
| 25 | (d) The Department shall file any rule necessary to | ||||||
| 26 | implement the provisions of this Section within 6 months after | ||||||

| 1 | the effective date of this amendatory Act of the 104th General | ||||||
| 2 | Assembly. | ||||||
| 3 | Section 99. Effective date. This Act takes effect upon | ||||||
| 4 | becoming law. | ||||||
