| 1 | AN ACT concerning local government. | |||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||||
| 4 | Section 5. The Regional Transportation Authority Act is | |||||||||||||||||||||
| 5 | amended by adding Section 3B.09d as follows: | |||||||||||||||||||||
| 6 | (70 ILCS 3615/3B.09d new) | |||||||||||||||||||||
| 7 | Sec. 3B.09d. Opioid antagonist requirement. All Commuter | |||||||||||||||||||||
| 8 | Rail Board trains shall carry naloxone or another opioid | |||||||||||||||||||||
| 9 | antagonist while in operation in case of an emergency. The | |||||||||||||||||||||
| 10 | opioid antagonist shall be stored in easily accessible spaces | |||||||||||||||||||||
| 11 | throughout the train cars. The opioid antagonist may only be | |||||||||||||||||||||
| 12 | administered by a train conductor or other individual trained | |||||||||||||||||||||
| 13 | in the use and administration of opioid antagonists. The | |||||||||||||||||||||
| 14 | Commuter Rail Board shall adopt rules to implement this | |||||||||||||||||||||
| 15 | Section. | |||||||||||||||||||||
| 16 | Section 10. The Good Samaritan Act is amended by adding | |||||||||||||||||||||
| 17 | Section 37 as follows: | |||||||||||||||||||||
| 18 | (745 ILCS 49/37 new) | |||||||||||||||||||||
| 19 | Sec. 37. Commuter Rail Board train conductor and other | |||||||||||||||||||||
| 20 | individuals; exemptions from civil liability for the | |||||||||||||||||||||
| 21 | dispensing of an opioid antagonist. A Commuter Rail Board | |||||||||||||||||||||
| |||||||
| |||||||
| 1 | train conductor or other individual trained in the use and | ||||||
| 2 | administration of opioid antagonists who in good faith | ||||||
| 3 | dispenses or administers an opioid antagonist, as defined in | ||||||
| 4 | Section 5-23 of the Substance Use Disorder Act, under Section | ||||||
| 5 | 3B.09d of the Regional Transportation Authority Act is not | ||||||
| 6 | liable for civil damages as a result of the conductor's or | ||||||
| 7 | other individual's acts or omissions, except for willful or | ||||||
| 8 | wanton misconduct on the part of the conductor or other | ||||||
| 9 | individual, in dispensing or administering the opioid | ||||||
| 10 | antagonist. | ||||||
| 11 | Section 99. Effective date. This Act takes effect January | ||||||
| 12 | 1, 2027. | ||||||
