| 1 | AN ACT concerning government. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 1. Short title. This Act may be cited as the | |||||||||||||||||||
| 5 | Honorable Funerals for First Responders Act. | |||||||||||||||||||
| 6 | Section 5. Definitions. As used in this Act: | |||||||||||||||||||
| 7 | "Elected official" includes any person appointed or | |||||||||||||||||||
| 8 | elected to any office in the State or a unit of local | |||||||||||||||||||
| 9 | government. | |||||||||||||||||||
| 10 | "First responder" includes: | |||||||||||||||||||
| 11 | (1) a law enforcement officer as defined in Section 2 | |||||||||||||||||||
| 12 | of the Line of Duty Compensation Act; | |||||||||||||||||||
| 13 | (2) a fireman as defined in Section 2 of the Line of | |||||||||||||||||||
| 14 | Duty Compensation Act; and | |||||||||||||||||||
| 15 | (3) emergency medical service personnel as defined in | |||||||||||||||||||
| 16 | Emergency the Medical Services (EMS) Systems Act. | |||||||||||||||||||
| 17 | "Honorable funeral" means a funeral that respects the | |||||||||||||||||||
| 18 | wishes of the deceased first responder and the family of the | |||||||||||||||||||
| 19 | deceased first responder and includes religious observances | |||||||||||||||||||
| 20 | desired by the deceased first responder and the family of the | |||||||||||||||||||
| 21 | deceased first responder. | |||||||||||||||||||
| 22 | Section 10. Honorable funeral services. Notwithstanding | |||||||||||||||||||
| |||||||
| |||||||
| 1 | any other provision of law, a first responder killed in the | ||||||
| 2 | line of duty shall receive an honorable funeral. | ||||||
| 3 | Section 15. Elected officials. An elected official may not | ||||||
| 4 | attend the funeral of a first responder killed in the line of | ||||||
| 5 | duty if the elected official knows, or has reason to know, that | ||||||
| 6 | the family of the first responder killed in the line of duty | ||||||
| 7 | does not wish the elected official to attend the funeral. In no | ||||||
| 8 | case shall any elected official be required to attend the | ||||||
| 9 | funeral of a first responder killed in the line of duty. The | ||||||
| 10 | family of the first responder killed in the line of duty shall | ||||||
| 11 | have sole discretion over which elected official may attend | ||||||
| 12 | the funeral of a first responder killed in the line of duty. | ||||||
| 13 | Before an elected official attends the funeral of a first | ||||||
| 14 | responder killed in the line of duty, the elected official | ||||||
| 15 | must make reasonable efforts to learn if the family of the | ||||||
| 16 | first responder killed in the line of duty would like the | ||||||
| 17 | elected official to attend the funeral. | ||||||
