SYNOPSIS AS INTRODUCED:

New Act
815 ILCS 505/2HHHH new

Creates the Paper Waste Reduction Act. Sets forth limits on the amount of junk mail a for-profit corporation, association, limited liability company, partnership, not-for-profit organization, or other legal entity shall send or cause to be sent to a person residing in the State. Provides that a violation of any of the provisions of the Act is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Amends the Consumer Fraud and Deceptive Business Practices Act making to make a conforming change.

A BILL FOR

AN ACT concerning business.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Paper Waste Reduction Act.

Section 5. Definition. As used in this Act, "junk mail" means any printed matter sent by mail that is not sent at the request of or with the express consent of the recipient for the purpose of encouraging the purchase or rental of, or investment in, property, goods, or services or soliciting any type of monetary donation or contribution.

Section 10. Limitations on unsolicited junk mail.

(a) A for-profit corporation, association, limited liability company, partnership, or other legal entity shall not send or cause to be sent junk mail to a person residing in this State more than 2 times in a calendar year unless that resident responds to the junk mail by contacting the sender or affirmatively requests that the sender continues to send junk mail to the person's address.

(b) A not-for-profit organization shall not send or cause to be sent junk mail to a person residing in this State more than 6 times in a calendar year unless that resident responds to the junk mail by contacting the sender or affirmatively requests that the sender continues to send junk mail to the person's address.

Section 15. Enforcement by the Attorney General. A violation of any of the provisions of this Act is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. All remedies, penalties, and authority granted to the Attorney General by that Act shall be available to him or her for the enforcement of this Act.

Section 90. The Consumer Fraud and Deceptive Business Practices Act is amended by adding Section 2HHHH as follows:

Sec. 2HHHH. Violations of the Paper Waste Reduction Act. A person who violates the Paper Waste Reduction Act commits an unlawful practice within the meaning of this Act.
