| 1 | AN ACT concerning business. | |||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||||
| 4 | Section 1. Short title. This Act may be cited as the Paper | |||||||||||||||||||||
| 5 | Waste Reduction Act. | |||||||||||||||||||||
| 6 | Section 5. Definition. As used in this Act, "junk mail" | |||||||||||||||||||||
| 7 | means any printed matter sent by mail that is not sent at the | |||||||||||||||||||||
| 8 | request of or with the express consent of the recipient for the | |||||||||||||||||||||
| 9 | purpose of encouraging the purchase or rental of, or | |||||||||||||||||||||
| 10 | investment in, property, goods, or services or soliciting any | |||||||||||||||||||||
| 11 | type of monetary donation or contribution. | |||||||||||||||||||||
| 12 | Section 10. Limitations on unsolicited junk mail. | |||||||||||||||||||||
| 13 | (a) A for-profit corporation, association, limited | |||||||||||||||||||||
| 14 | liability company, partnership, or other legal entity shall | |||||||||||||||||||||
| 15 | not send or cause to be sent junk mail to a person residing in | |||||||||||||||||||||
| 16 | this State more than 2 times in a calendar year unless that | |||||||||||||||||||||
| 17 | resident responds to the junk mail by contacting the sender or | |||||||||||||||||||||
| 18 | affirmatively requests that the sender continues to send junk | |||||||||||||||||||||
| 19 | mail to the person's address. | |||||||||||||||||||||
| 20 | (b) A not-for-profit organization shall not send or cause | |||||||||||||||||||||
| 21 | to be sent junk mail to a person residing in this State more | |||||||||||||||||||||
| 22 | than 6 times in a calendar year unless that resident responds | |||||||||||||||||||||
| |||||||
| |||||||
| 1 | to the junk mail by contacting the sender or affirmatively | ||||||
| 2 | requests that the sender continues to send junk mail to the | ||||||
| 3 | person's address. | ||||||
| 4 | Section 15. Enforcement by the Attorney General. A | ||||||
| 5 | violation of any of the provisions of this Act is an unlawful | ||||||
| 6 | practice under the Consumer Fraud and Deceptive Business | ||||||
| 7 | Practices Act. All remedies, penalties, and authority granted | ||||||
| 8 | to the Attorney General by that Act shall be available to him | ||||||
| 9 | or her for the enforcement of this Act. | ||||||
| 10 | Section 90. The Consumer Fraud and Deceptive Business | ||||||
| 11 | Practices Act is amended by adding Section 2HHHH as follows: | ||||||
| 12 | (815 ILCS 505/2HHHH new) | ||||||
| 13 | Sec. 2HHHH. Violations of the Paper Waste Reduction Act. A | ||||||
| 14 | person who violates the Paper Waste Reduction Act commits an | ||||||
| 15 | unlawful practice within the meaning of this Act. | ||||||
